The image is irreplaceable

The image of Chinmoy Barma, being discussed in the context of Wikipedia, is deemed irreplaceable due to its unavailability in the public domain without copyright restrictions. This means that a freely licensed or public domain alternative image of Chinmoy Barma cannot be sourced or located, making the currently existing image uniquely valuable for Wikipedia. So, i have requested you to keep the image as it was.

@Thesaurabhsaha: Non-free images of still living persons are pretty much never allowed because they are almost always considered replaceable per WP:FREER and item 1 of WP:NFC#UUI; in other words, it's considered reasonable for someone somewhere to take a photo of the same person at some point in time and then upload their photo to Wikipedia or Wikimedia Commons under an acceptable free license, thus making any non-free one unacceptable per relevant Wikipedia policy. This doesn't have to be a free version of the same image, it only needs to be a free version that can serve essentially the same encyclopedic purpose as this or any other non-free one. In addition, the permission of the subject of the photo doesn't matter when it comes to non-free photos like this unless they are (1) also the copyright holder of the photo and (2) they are willing to give their WP:CONSENT and release the photo under an acceptable free license. Under pretty much all copyright laws worldwide, the copyright holder of a photo is the person who takes the photo; it's not the subject of the photo. So, the permission of the subject of a photo only matters if they took the photo themselves or the copyright of the photo was legally transferred to them by the person who did take the photo. If the copyright holder is will to give their CONSENT to release the photo under an acceptable free license, the file can be relicensed accordingly and kept. If you're the copyright holder of the image, you should follow the guidance given here here. If you're not the copyright holder of the image, you should follow the guidance given here. If you've been able to get the copyright holder's c:COM:CONSENT and the copyright has emailed c:COM:VRT, you should probably let this file being deleted and then re-upload an higher resolution version with full EXIF data to Wikimedia Commons. Please note that it's not sufficient for the copyright holder to give their consent to only you or to only Wikipedia; the copyright holder needs to basically be will to give their CONSENT to everyone in the world to download the file at anytime and re-use for any purposes (including commercial purposes, derivative purposes or in other ways that the copyright might not like). Moreover, the copyright holder's CONSENT need to be verifiable in some way and one way to do this is for the copyright holder to email a CONSENT email to Wikimedia VRT. Lastly, once again, the copyright holder is, in principle, the person who takes the photo, not the person being photographed, and only the copyright holder can give their consent. -- Marchjuly (talk) 13:12, 27 May 2023 (UTC)[reply]
