Yes you are quite right, but per WP:FAKEARTICLE we could have added {{Userspace draft}} years ago, and it would now be G13. (I have said elsewhere that I think we should be very cautious about pushing the envelope on speedies, and I am not that keen on g13 anyway, but in this case the page is 1) created by a banned user 2) in the user space of another inactive user 3) allegedly against the will of that other user and 4) contains no useful content.)
