This article says he was born in 1862, but the statue text says 1871. Which is correct? ShadowMan1od 04:32, 23 October 2006 (UTC)[reply]

It is 1871. The wiki article was wrong. I fixed it. Duffy = War Criminal?

A priest is not allowed to take part in fighting, according to the Geneva Convention and the United Nations Declaration of Human Rights. Therefore, it seems to me, Father Duffy could have been a War Criminal. Some legal experts here who confirm this? 93.219.148.34 (talk) 15:29, 24 November 2013 (UTC)[reply]

  • That's a specious argument. First, Duffy was in a war 60 years before the rule was established (protocol I, 43.2, was in 1977)--you can't apply international law that didn't exist at the time to a conflict that happened before it existed. The Geneva conventions post-1977 only preclude a priest from "direct participation" in combat. Direct participation is non-defensive. There are no such provisions in either the four Geneva Conventions and its protocols or the UNDHR that prevents a priest from being armed or from defending himself in a combat situation. Self-defense is not direct action. The issue is moot because the provision didn't exist, and the principle of ex post facto means we don't apply the force of new laws or morals to the events that predate their enactment.--ColonelHenry (talk) 17:36, 24 November 2013 (UTC)[reply]
